Layan Verde is a large off-plan resort and residence development in Phuket’s Layan area. The developer presents a 7.5-hectare site, more than 200,000 square metres of built area, extensive landscaping, more than 65 amenities and over 700 parking spaces. Dusit International has announced an agreement to manage dual-branded hotel and residence components. Those features make the project easy to notice, but a buyer decision should begin with documents, ownership structure and contractual remedies rather than renders or projected returns.

Identify the legal seller

Confirm the Thai company named in the reservation form and sale agreement, then match its registration number, directors and authority to sign. A project brand, marketing agent and management company may be different legal entities. Payment instructions should point only to the verified contractual counterparty or an agreed escrow structure. Ask an independent lawyer to explain exactly who owes the buyer each obligation.

Verify land and permits

Obtain current title documents, land-office searches, building permits and the environmental impact assessment approval where required. Check whether mortgages, leases, servitudes or litigation affect the site. Marketing material that says documents exist is not a substitute for copies and official verification. Confirm that the approved plans match the building, unit, floor and use described in the contract.

Understand ownership

Foreign buyers need clear advice on condominium freehold quota, leasehold or other structures. A label such as residence, villa or investment unit does not determine legal ownership. Confirm whether the selected unit is registered under the Condominium Act, how common property is held, what happens when the foreign quota is unavailable and whether funds must be transferred from abroad with the correct bank evidence.

Read the payment schedule

Off-plan contracts often require staged payments before completion. Tie each stage to a measurable construction milestone, documentary evidence and a right to inspect. Identify the final completion date, grace period, interest, termination rights and refund mechanism. If the developer can extend unilaterally while the buyer faces strict penalties, the risk is asymmetric. Do not transfer a reservation fee until refund conditions are written.

Separate Dusit’s role

Dusit’s management announcement is relevant, but management does not make the hotel company the developer, seller or guarantor of construction. Read the branded residence agreement, rental programme and management terms separately. Check the contract length, termination rights, owner-use limits, furnishing standards, fees and what happens if the brand or operator changes before or after completion.

Test the cost model

Add common-area fees, sinking fund, management charges, utilities, insurance, maintenance, furnishing, tax, transfer fees and rental-programme deductions. Large amenity lists create ongoing operating costs. Ask for a first-year budget and the legal basis for future increases. Compare net ownership cost with completed alternatives, not just the developer’s headline price per square metre.

Treat returns as marketing

Rental yields, capital growth and occupancy are forecasts unless backed by a legally enforceable guarantee from a creditworthy party. Ask for the assumptions behind every projection, including room rate, occupancy, commissions, replacement reserve and owner-use restrictions. Model a lower-demand scenario and a delayed completion. A property should remain affordable even if marketing forecasts are not achieved.

Inspect the location

Layan offers beach and resort appeal but daily life depends on road access, drainage, construction around the site, shops, schools and medical facilities. Visit in rain and at peak traffic. Walk the boundaries, confirm the view from the actual unit level and identify neighbouring plots that could be developed. A rendering cannot show future noise, traffic or blocked sightlines.

Use independent advisers

The buyer’s lawyer, surveyor, tax adviser and currency specialist should not be selected or paid only by the seller. Give them enough time to review Thai and translated documents. Ask for written advice on ownership, tax, inheritance and exit. If an answer depends on a future official decision, treat it as unresolved rather than filling the gap with a sales assurance.

Quick questions

Is Layan Verde completed? It is marketed as an off-plan development, so buyers should verify the current construction stage and contractual completion date.

Does Dusit guarantee the investment? No such guarantee should be assumed. Dusit announced a management agreement, which is different from being the developer or construction guarantor.

Layan Verde may appeal to buyers seeking a highly amenitised Phuket residence, but scale and branding increase the number of contracts and costs to understand. Verify the seller, land, approvals, unit ownership and completion remedies before paying. Treat every return estimate as a scenario, and let an independent legal review determine what the buyer can actually enforce.

Plan the exit before entry

A buyer should understand resale and inheritance before signing. Ask whether the contract restricts assignment during construction, what transfer fee applies, who approves a new buyer and whether the rental programme limits sale timing. For leasehold, review renewal language carefully and do not treat an option as equal to a guaranteed term if enforcement is uncertain. Confirm how a foreign owner’s estate would transfer the property and what Thai will or succession planning is appropriate. Liquidity can be limited in large resort developments with many similar units, so model a longer selling period and price competition from the developer’s unsold stock. An attractive entry offer does not ensure a convenient exit.
